Terms and Conditions

GENERAL

Acceptance of General Terms and Conditions of sale

Confirmation of an order implies acceptance of the General Terms and Conditions of sale of Domaine La Garelle and of the prices currently in force. N.B. The images and photographs appearing on Domaine La Garelle’s website are not contractual.

Minors

Article L33421–1 of the law of 21st July 2009 of the Code of Public Health (Code de la Santé Publique) forbids the sale of alcohol to minors of less than 18 years of age. Consequently, the buyer undertakes when he confirms an order that he was at least 18 years old when he placed the order.

PRICE

Prices are given in euros, including relevant taxes ,but not including freight. Freight charges and Customs duties, where applicable, will be invoiced separately.

Domaine La Garelle reserves the right to change its prices at any moment, but orders will be filled at the prices obtaining at the date on which they were confirmed.

PAYMENT

The buyer can settle the amount of his order by any of the following means :

  • by credit card on line:
    • payments by bank card are securely handled by Crédit Agricole’s server.
    • Cards accepted: Mastercard, Visa
      Any problems encountered with this system of payment will be dealt with by Crédit Agricole.NB :  Domaine La Garelle at no time has access to its customer’s bank details

 

  • by bank or postal cheque :
    • Cheques should only be drawn on banks domiciled in metropolitan France, made out to order of Domaine La Garelle and mailed to the address below:

    • Orders will be filled after the receipt and clearance of cheques.

DELIVERY

Delivery will be made in metropolitan France – including Corsica – and in Europe in multiples of 6 bottles of 75 centilitres.

Delivery charges will be waived for any order of 120 or more bottles.

Availability

In case of non-availability of any of the products ordered, La Garelle will contact the buyer by email or telephone and either suggest alternative products or, if preferred, arrange reimbursement of the corresponding payment.

Delivery time

Delivery times are normally 7 calendar days in France and 14 calendar days abroad. These timings are only given as an indication and Domaine La Garelle can accept no penalty or cancellation of order if goods happen to be delayed for longer than this.

A confirming email will be sent to the customer as soon as his payment is encashed and the order dispatched. The delivery will be made to the address supplied by the customer. If, however, the goods should be returned to La Garelle due to an inaccurate or incomplete address, the customer will be informed and any costs for redispatch to the corrected address will be at the customer’s charge.

Claims

In case of damage or loss, the details must be noted on the delivery receipt before it is signed by the receiver on delivery, and the customer should inform Domaine La Garelle by telephone email or fax within 48 hours.

If the customer signs the delivery receipt without any reserve, he forfeits his right to having any of the goods replaced or reimbursed.

RIGHT OF RETURN

In accordance with article L 121–20 of the “Code de Consommation”, the client has 7 days from the date of receipt of the goods in which to return them to Domaine La Garelle, in their original packing. This “right of return” is free of charge to the client, except for the return freight charges.

CANCELLATION OF ORDER

For it to be accepted, any request for the cancellation of an order must reach Domaine La Garelle at least 24 hours before the order is to be dispatched. Such a cancellation can be made by email, fax or telephone.

FORCE MAJEURE

Domaine La Garelle cannot be held responsible for loss, damage, delay in delivery or cancellations due to circumstances beyond its control – e.g. storm, fire, earthquake, flooding, lightning, strikes, obstructions of means of transport or communications networks etc.

MAINTENANCE OF OWNERSHIP

In conformity with the terms of Law no. 80 335 of 1st May 1980, produce remains the property of Domaine La Garelle until the completion of payment for the order,

LEGAL JURISDICTION

These General Terms and Conditions of Sale are subject to French law. Cases of litigation which cannot be settled amicably will be heard by the Avignon (Vaucluse) Tribunal de Commerce.

LEGAL LANGUAGE

The original French version of these General Terms and Conditions remains their sole official legal version.
